We process personal data that we receive from our customers as part of our business relationship. In addition, we process - to the extent necessary for the provision of our deliveries and services - personal data that we legitimately obtain from publicly accessible sources (e.g. the Internet) or are legitimately transmitted by other third parties (e.g. a credit agency). Relevant personal data are personal details (name, address and other contact details).

How do we process your data (purpose of processing) and on what legal basis?

We process personal data in accordance with the provisions of the European General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG):

a. For the fulfillment of contractual obligations (Art. 6 para. 1 b GDPR)
The processing of data takes place for the acquisition of customer orders, the processing of orders placed for the delivery of our products and services currently being sold.

b. As part of the balancing of interests (Art. 6 para. 1 f GDPR)
If necessary, we process your data beyond the actual fulfillment of the contract to protect our legitimate interests or those of third parties.
Examples:

  • Examination and optimization of procedures for needs analysis for the purpose of direct customer contact
  • Advertising or market and opinion research, provided you have not objected to the use of your data

c. On the basis of your consent (Art. 6 para. 1 a GDPR)
If you have given us your consent to process personal data for specific purposes, the lawfulness of this processing is based on your consent. You can withdraw your consent at any time.This also applies to the revocation of declarations of consent given to us before the GDPR came into force, i.e. before May 25, 2018. The withdrawal of consent does not affect the lawfulness of the data processed prior to the withdrawal.

Who is receiving my data?

Within the company, those departments that need your data to fulfill our contractual and legal obligations will have access to it. Service providers and vicarious agents employed by us may also receive data for these purposes, provided that a confidentiality agreement exists with these companies.

Is data transferred to a third country or to an international organization?

Data is transferred to bodies in countries outside the European Union (so-called third countries) if

  • it is necessary for the execution of your orders
  • it is required by law

Beyond this, the company does not transfer any personal data to bodies in third countries or international organizations.

How long will my data be stored?

We process and store your personal data for as long as is necessary to fulfill our contractual and legal obligations. It should be noted that our business relationship is a continuing obligation that is intended to last for years.If the data is no longer required for the fulfillment of contractual or legal obligations, it is regularly deleted.

What data protection rights do I have?

Every data subject has the right of access under Article 15 GDPR, the right to rectification under Article 16 GDPR, the right to erasure under Article 17 GDPR, the right to restriction of processing under Article 18 GDPR, the right to object under Article 21 GDPR and the right to data portability under Article 20 GDPR. The restrictions under Sections 34 and 35 BDSG apply to the right of access and the right to erasure. In addition, there is a right of appeal to a competent data protection supervisory authority (Article 77 GDPR in conjunction with Section 19 BDSG). You can withdraw your consent to the processing of personal data at any time. This also applies to the revocation of declarations of consent given to us before the General Data Protection Regulation came into force, i.e. before May 25, 2018. Please note that the revocation is only effective for the future.Processing that took place before the revocation is not affected.

Do I have an obligation to provide data?

As part of our business relationship, you must provide the personal data that is necessary for the establishment and execution of a business relationship and the fulfillment of the associated contractual obligations or that we are legally obliged to collect.

To what extent is there automated decision-making?

In principle, we do not use fully automated decision-making in accordance with Art. 22 GDPR to establish and conduct the business relationship.Should we use these procedures in individual cases, we will inform you of this separately if this is required by law.

Does profiling take place?

We do not process data automatically with the aim of evaluating certain personal aspects.

How is personal data processed on our website?

Our website uses Matomo, which is a web analysis service. Matomo uses so-called “cookies”, which are text files that are stored on your computer and enable us to analyze the use of the website. For this purpose, the usage information generated by the cookie (including your shortened IP address) is transmitted to our server and stored for usage analysis purposes, which serves to optimize our website. Your IP address is immediately anonymized during this process so that you as a user remain anonymous to us.

The information generated by the cookie about your use of this website is not passed on to third parties. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website.

1. Right to object on a case-by-case basis
You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on Article 6(1)(e) GDPR (data processing in the public interest) and Article 6(1)(f) GDPR (data processing on the basis of a balancing of interests); this also applies to profiling based on this provision within the meaning of Article 4(4) GDPR.If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defense of legal claims.

2. Right to object to the processing of data for direct marketing purposes
In individual cases, we process your personal data for direct marketing purposes.You have the right to object at any time to the processing of personal data concerning you for the purpose of such advertising.
This also applies to profiling insofar as it is associated with such direct advertising.
If you object to processing for direct marketing purposes, we will no longer process your personal data for these purposes.
